Terms of Service
These Terms of Service (“Terms”) govern your use of the Constancy Android application (package me.constancy.app) and the website at https://constancy.me (together, the “Service”), operated by Constancy. By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Constancy is a habit-tracking app focused on consistency: logging small daily actions and viewing streaks and progress. Features may change over time as we improve the product.
2. Eligibility
You must be able to form a binding contract in your jurisdiction and meet any minimum age required by Google Play and applicable law. The Service is not directed at children under 13.
3. Accounts
Some features require an account (email/password or Google Sign-In). You are responsible for safeguarding your credentials and for activity under your account. Provide accurate information and notify us of unauthorized use at hello@constancy.me.
4. Freemium and Premium
Constancy is offered on a freemium basis:
- Free: up to 3 active habits; local-only storage; basic charts (approximately a 7-day window); default theme. Free users do not receive cloud sync or habit reminders.
- Premium: unlimited habits; cloud sync when signed in; local habit reminders; advanced stats/heatmaps and longer analytics windows; additional themes; AI habit suggestions (up to 10 generations per calendar month).
Feature limits and Premium inclusions may be updated; material changes to paid features will be communicated reasonably where practicable.
5. Subscriptions and billing
- Premium is sold as auto-renewing subscriptions (for example monthly or yearly) through Google Play Billing.
- Prices, free trials (if any), and billing periods are shown in the Play Store / paywall at purchase time.
- Payment is charged to your Google Play account. Subscriptions renew automatically unless cancelled according to Google Play’s cancellation flow before the renewal date.
- Manage or cancel subscriptions in Google Play subscription settings. Deleting the app does not automatically cancel a subscription.
- Entitlements may be verified via RevenueCat in addition to Google Play. Use Restore purchases in the app if Premium does not appear after reinstall or device change.
- Refunds are handled under Google Play’s refund policies unless required otherwise by law.
6. AI suggestions
Premium AI habit suggestions are optional productivity aids. They are not medical, mental-health, financial, or other professional advice. Outputs may be inaccurate or unsuitable; you decide whether to follow them. Usage is rate-limited (currently 10 generations per calendar month). AI processing may involve third-party providers such as Google Gemini as described in our Privacy Policy.
7. Acceptable use
You agree not to:
- Misuse the Service, attempt unauthorized access, or disrupt systems.
- Reverse engineer the app except where permitted by law.
- Use the Service for unlawful, harmful, or abusive purposes.
- Abuse AI features (for example automated scraping of quotas).
- Misrepresent affiliation with Constancy.
8. Intellectual property
The Service, including software, branding, and content we provide, is owned by Constancy or its licensors. You receive a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes in accordance with these Terms and Google Play’s terms. Habit content you create remains yours; you grant us a license to host and process it as needed to operate sync and related features.
9. Privacy
Our Privacy Policy explains how we handle personal data. By using the Service, you also acknowledge that policy.
10. Account deletion and termination
You may delete your account and associated cloud data in-app viaProfile → Delete account & data, or contact hello@constancy.me. Local device data may remain until you clear app storage or uninstall.
We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the Service. We may modify or discontinue features with reasonable notice where practicable.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. We do not warrant uninterrupted or error-free operation, or that streaks, reminders, sync, or AI outputs will meet your goals.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONSTANCY AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR PREMIUM IN THE 12 MONTHS BEFORE THE CLAIM OR (B) AUD 50, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.
13. Indemnity
You agree to indemnify and hold harmless Constancy from claims arising out of your misuse of the Service or violation of these Terms, to the extent permitted by law.
14. App stores
Your use of Google Play is also subject to Google’s terms. Google may be a third-party beneficiary of these Terms with respect to the Play distribution of the app.
15. Changes to these Terms
We may update these Terms periodically. The “Last updated” date will change when we do. Continued use after changes become effective constitutes acceptance, except where additional consent is required by law.
16. Governing law
These Terms are governed by the laws of Australia, without regard to conflict-of-law rules, except where mandatory consumer protections in your country of residence apply and cannot be waived.
